Introduction:

In the highly competitive world of business, protecting your brand is no longer optional—it is a necessity. For companies operating in the UAE, trademark registration offers legal protection against infringement and ensures that the time, effort, and capital spent on developing a brand do not go to waste. Dubai, being a key commercial hub of the Middle East, experiences a high influx of local and foreign businesses. With the UAE importing most goods and services from abroad, the need for solid legal protection through trademark registration becomes even more crucial.

This guide provides a detailed overview of the procedure for registering a trademark in Dubai, along with the legal requirements and documentation involved.

Trademark Registration Criteria in Dubai, UAE:

To register a trademark in the UAE, certain criteria must be met:

  1. Types of Trademark Applications:
Applications can be filed for word marks, logos, designs, or combinations thereof.
  2. Classification System:
The UAE follows the 11th edition of the Nice Classification for goods and services.
  3. Prohibited Classes:
Class 33 (related to alcoholic beverages) is not permitted under UAE law.
  4. Single-Class System:
The UAE Trademark Office accepts applications on a per-class basis. If you need protection under multiple classes, each requires a separate application.
  5. Eligibility:
    • Applications can be filed by individuals or companies.
    • Companies operating within Free Zones or offshore jurisdictions are eligible.
    • Foreign individuals and companies are also eligible, provided they apply through a registered trademark agent in the UAE.
  6. Validity and Renewal:
    • Registered trademarks are valid for 10 years.
    • Renewal is possible for additional 10-year terms, provided the renewal is filed before the expiration date.
  7. Trade License Requirement:
A valid UAE trade license is not mandatory for UAE residents applying as individuals.

Step-by-Step Trademark Registration Procedure in Dubai:

1. Application Submission:

The process begins with submitting a formal trademark application to the UAE Ministry of Economy. The application must be complete with all supporting documents.

Required Documents:

A. For Individual Applicants (UAE Residents):

  • Trademark image in PDF format.
  • Full residential address.
  • Power of Attorney (notarized by a Notary Public in UAE).

B. For Companies Based in UAE:

  • Trademark image in PDF format.
  • Trade license copy.
  • Power of Attorney (notarized).

C. For Foreign Companies:

  • Trademark image in PDF format.
  • Power of Attorney (notarized and legalized by the UAE Consulate in the applicant’s country).

2. Examination by the Ministry:

Once the application is submitted, the Ministry of Economy reviews it. A decision is typically issued within 30 days. If the trademark complies with legal standards and is not similar to existing trademarks, the application proceeds to publication.

3. Publication:

The approved application is published in the official UAE Trademark Bulletin. This step allows the public to file any objections within 30 days of publication.

4. Opposition Period:

If no opposition is filed within the stipulated time, or if objections are resolved, the application proceeds to final registration.

5. Issuance of Certificate:

Once approved, the Ministry of Economy issues a Certificate of Registration. This certificate includes:

  • Registration number.
  • Application and registration dates.
  • Owner’s name and nationality.
  • Trademark image.
  • Description of goods or services covered under the trademark.
