Is Your Trademark Available in the UAE? How to Check Before You File

Choosing a brand name is exciting. Filing it without checking first can be costly. A trademark application in the UAE can be objected to, or opposed by another owner, if a similar mark already exists for the same or related goods and services. A quick search before filing saves time, fees and the cost of rebranding later.

Why a search before filing matters

The Ministry of Economy examines every application. After acceptance, the mark is published and others have 30 days to oppose it. If a similar mark is already on record, your application may be refused or opposed, and you may have to change the name after investing in packaging, signage and marketing.

What "similar" really means

Two marks do not have to be identical to conflict. Similarity can be:

  • Visual: spelling that looks alike, such as an extra or missing letter.
  • Phonetic: names that sound alike, even if they are written differently.
  • Across languages: an English name and its Arabic transliteration, which is very common in the UAE.
  • Conceptual: names with the same meaning or idea.
  • Shared distinctive words: a mark that contains another mark as a separate word.

Classes matter as much as the name

Every application covers one or more Nice classes, for example class 30 for coffee and bakery products or class 43 for restaurants. A similar name in the same class is the highest risk. A similar name in a related class can also be a problem, because consumers may think the goods come from the same source. That is why a good search looks at your class and its related classes, not only at identical names.

Common mistakes we see

  • Searching only the exact spelling, and missing phonetic or Arabic-English matches.
  • Choosing a name made mainly of descriptive words, such as "Fresh", "Gold" or "Home", which are hard to protect.
  • Filing in the wrong class, or in too few classes, for the real business.
  • Investing in branding before checking the name at all.

A search is a starting point, not a guarantee

A preliminary search shows you where the risks are. It is not a guarantee of registration: the final decision rests with the examiner at the Ministry of Economy, and recently filed or unpublished applications may not appear in any search. When the result shows a risk, a professional review is the safest next step.
