FAQ
Questions about disputes
How long do I have to oppose a published mark?
30 days from the publication date. After that, a cancellation action is usually the remaining route.
My mark was refused. Can it still be registered?
Often, yes. An appeal can challenge the refusal, and restricting the goods or services can remove the conflict.
Can a dispute be settled without a decision?
Yes. The parties can agree coexistence or amend their specifications, which is often faster and less costly.
What evidence matters most?
Dated evidence of use and reputation, such as invoices, advertising, sales figures and prior registrations.
